Taiwan fast-tracks stricter crypto AML rules to take effect Nov. 30

Taiwan is set to implement stricter anti-money laundering (AML) regulations for cryptocurrency service providers, effective November 30, 2024. This early enforcement marks a significant step in the country’s efforts to enhance regulatory oversight within the rapidly growing crypto sector.

Overview of New Regulations

  • Registration Requirement: All crypto service providers, including exchanges, must complete AML compliance registration. Failure to comply could result in severe penalties, including fines and potential imprisonment.
  • Expanded Compliance Framework: The new rules will replace existing regulations and require virtual asset service providers (VASPs) to adhere to stricter guidelines concerning identity verification and transaction monitoring.

Goals and Implications

The Taiwanese Financial Supervisory Commission (FSC) aims to establish clearer licensing standards and improve consumer protection through these regulations. The FSC has already noted that 26 exchanges have complied with the current AML laws, with additional applications under review. This move is part of a broader strategy to align Taiwan’s financial regulations with those of other major financial hubs like Hong Kong and Singapore, thereby enhancing its competitiveness in the global financial market.

Future Developments

In addition to the immediate implementation of these AML rules, the FSC is drafting a “Special Law for Crypto Exchange Management” introducing more comprehensive regulatory measures. Public hearings for this proposed law are expected in early 2025, allowing for community input on future crypto regulations. This proactive approach by Taiwan reflects a growing recognition of the need for robust regulatory frameworks in the face of increasing concerns about illicit activities associated with cryptocurrencies.
